Creion Reach Terms of Use

Welcome to Creion Reach

Creion Reach (“we,” “us,” “our”) provides a platform, including a website and mobile applications (collectively, the “Creion Reach Site”), to enable individuals and organizations (“Campaign Organizers”) to raise funds for their causes. It also allows visitors (“Donors”) to contribute to these campaigns (collectively, “Users”).

These “Terms of Use” (the “Terms”) constitute a legally binding contract between you (“you,” the “User”) and Creion Reach regarding access to and use of the Creion Reach Site and its services (the “Services”). By accessing or using the site or services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Creion Reach Site or Services.

Account Registration and Use

Users may be required to register for an account to create a fundraising campaign or access certain features. Users agree to provide accurate, current, and complete information during registration and to keep it updated. Users are responsible for safeguarding their password and for all activities under their account. Users must immediately notify Creion Reach of any unauthorized use of their account.

The Services are intended for users who are at least 13 years of age. If a user is under 18, they may only use the Services with the involvement and consent of a parent or guardian.

User Responsibilities and Conduct

As a User, you are entirely responsible for all content you post, upload, or transmit through the Creion Reach Site (“User Content”), including campaign descriptions, images, and updates.

You agree you will not:

Use the Services for any unlawful purpose or to promote illegal activities or contravention of any of the laws of the Republic of Ghana.
Create campaigns that involve raffles, lotteries, games of chance, or any activity that could be considered gambling.
Harass, defame, intimidate, or threaten other users.
Post content that is fraudulent, false, misleading, or infringes on any third party’s intellectual property, privacy, or publicity rights.
Post content that is obscene, hateful, or otherwise objectionable.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Use the Services to collect personal information from others without their consent.
Introduce viruses, worms, or any other malicious code.
Interfere with or disrupt the integrity or performance of the Creion Reach Site.

Campaigns and Donations

A. Campaign Organizers:

You represent and warrant that you will use donations solely for the purpose described in your campaign. You are responsible for the accurate and transparent communication of your cause and the use of funds. Creion Reach does not guarantee that a campaign will reach its goal or that funds will be used for their stated purpose, and we are not liable for a Campaign Organizer’s failure to do so.

B. Donors:

Donations are voluntary and are generally not refundable. Creion Reach is not responsible for and does not engage in any dispute between a Donor and a Campaign Organizer regarding the use of donated funds. All donations are made at your own risk.

Fees and Payments

Creion Reach charges a platform fee on donations received, as detailed on our Pricing page. Additional payment processing fees may apply. We reserve the right to change our fee structure at any time, and we will provide notice of such changes on our website. All fees are exclusive of applicable taxes, levies, or duties.

Intellectual Property

The Creion Reach Site, its content, and its underlying technology are the property of Creion Reach and our licensors and are protected by copyright, trademark, and other laws. By posting User Content, you grant Creion Reach a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content in connection with operating and providing the Services.

Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information and is incorporated into these Terms by reference.

Third-Party Links and Services

The Creion Reach Site may contain links to third-party websites or services. We do not endorse and are not responsible for the content or practices of any third-party sites. Your interactions with these third parties are solely between you and the third party.

Disclaimer of Warranties

THE CREION REACH SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CREION REACH AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.

Indemnification

You agree to indemnify and hold harmless Creion Reach and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your User Content, or your violation of these Terms.

Termination

We may suspend or terminate your account or access to the Services at any time, with or without cause or notice. Upon termination, your right to use the Services will immediately cease.

Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Ghana, without regard to the conflict of laws principles of your home state. Any dispute arising from these Terms or your use of the Services shall be resolved through mediation at the Ghana arbitration center, failing which the parties shall resolve it using the Ghanaian courts. You however waive any right to participate in a class-action lawsuit.

Changes to Terms

We may modify these Terms at any time. We will post the revised Terms on the Creion Reach Site with an updated “Last Updated” date. By continuing to use the Services after the changes take effect, you agree to the revised Terms.
